Principal Magistrate David Simusamba has thrown out the bail pending appeal application for convicted NDC leader Chishimba Kambwili on grounds that it was irregularly before him.
When the matter came up for hearing in a packed courtroom which included UPND President Hakainde Hichilema, RPP leader James Lukuku, NDC Vice President Josephs Akafumba and Roan lawmaker Joseph Chishala, Magistrate Simusamba could not go ahead to listen to the application as it was made before time.
He said there was no way he could entertain an appeal application which was lodged in way before he had concluded with his judgement made last week and therefore rejected it.
Defence Counsel Eddie Mwiitwa who tried to amend the appeal from the bar applied that the matter be heard in chamber to which the Magistrate granted.
By press time, Magistrate Simusamba is meeting the state and defence in his chambers and we wait to know whether the amended appeal application will be entertained and Dr Kambwili granted bail today.
President Hichilema remains in court as he waits the outcome of the chamber discussion.
